Divorce and pillar 3a: build the asset history before discussing the split
Pillar 3a division is not the same process as occupational-pension splitting. The matrimonial regime and funding history come first.

One separation, several pension mechanisms
Divorce can involve AVS income splitting, occupational-pension division and the treatment of pillar 3a assets. These mechanisms should not be collapsed into one instruction to divide every balance equally. The OFAS guidance checked on 14 October 2026 says that 3a allocation depends on the matrimonial property regime; under ordinary participation in acquired property, assets built during marriage are generally shared by halves. That is a starting principle, not an assessment of your individual file. A marriage contract, inherited funding, earlier balances or international circumstances can require specialist analysis before any settlement is signed.
Reconstruct the history, not just today's value
Request statements at marriage and at the relevant dates identified by your legal adviser, alongside contribution and transfer records. List every bank account and insurance-based 3a contract. With an insurance contract, distinguish the displayed projected maturity benefit from the current value the provider can certify for the proceedings. Do not assume either annual premiums or a future forecast equals today's divisible asset. Mark missing information explicitly. A concise chronology of account opening, provider changes, withdrawals and reinvestments is more useful than an unexplained pile of documents showing only the most recent balance.
A hypothetical file with unanswered questions
Suppose one spouse had CHF 20,000 in a bank 3a before marriage and the account now shows CHF 80,000. Simply calling CHF 60,000 shared property may overlook returns, transfer history and the origin of later contributions. Imagine CHF 10,000 came from an inheritance, while another contract was funded from earnings. The couple's lawyer needs evidence and applicable rules before assigning values. The example deliberately has no final split: it demonstrates why a subtraction is not always a legally complete calculation. Each provider should supply documentary values rather than the couple relying on screenshots or memory.
Negotiate without accidentally ending protection
Separating a savings entitlement from an insurance policy can also affect death or incapacity cover. Ask the provider how a proposed transfer, reduction or restructuring would be implemented and whether risk benefits remain. A faster settlement has value, but surrendering a contract merely to simplify paperwork can create charges or an uninsured interval. Conversely, keeping an unsuitable contract solely because the separation is stressful can preserve an expensive commitment. Review the financial settlement and the future protection needs as two linked decisions. Obtain implementation and cost information before treating an informal agreement as operationally executable.
The useful handover to professional advisers
Prepare an inventory with provider, contract identifier, certified value, relevant dates, funding evidence and outstanding questions. Give the lawyer the marriage contract and international facts, not only the insurance quotation. Ask what instruction the 3a provider will need and where transferred pension money must go; do not send it to an ordinary account on your own initiative. After the settlement, request confirmation that the provider's records and beneficiary arrangements reflect the lawful outcome. Rebuild your retirement budget using the assets actually retained. This dossier supports preparation; it cannot determine ownership, taxes or an enforceable division without the complete case.
